Policies & Agreements

FlawlesslyPolishedd LLC - Licensing of Commissioned Artwork

This Licensing Agreement ("Agreement") is entered into between: Illustrator/Studio -FlawlesslyPolishedd LLC (the “Business”) and You (the “Client/Purchaser”) dated for the date/time of checkout.

1. Grant of License

FlawlesslyPolishedd LLC ("Illustrator/Business") grants the Author a non-exclusive, non-transferable, perpetual license to use the purchased or commissioned artwork ("Artwork") for:

Book covers (print & digital)
Album covers (print & digital)
Interior pages
Promotional materials (ads, social media, trailers, banners)
Merchandise (See Section 4)
Cropping/resizing is allowed.
No alterations or derivatives without approval.

2. Ownership & Copyright

(“Illustrator/Business”) retains full copyright.
(“Purchaser”) is licensing usage rights only.
(“Illustrator/Business”) may display the Artwork in portfolios and promotional materials
Characters are never duplicated, however (“Illustrator/Business”) may use sketch to create new pre-made (“Artwork”)

3. Fees

Commission Fee: $
Exclusive Rights Fee: +$100 (optional)
All fees must be paid before final files are released.

4. Merchandising Rights (Included)

(“Purchaser”) may use (“Artwork”) on merchandise including posters, apparel, stickers, bookmarks, cards, and swag. No royalties owed.

5. Exclusivity Option

Default: non-exclusive. For +$100, (“Purchaser”) receives exclusive rights for their (“Artwork”). ("Illustrator/Business”) may still display Artwork in portfolios.
What exclusivity means: (“Purchaser”) owns exclusive rights to rendered artwork and sketch. ("Illustrator/Business”) cannot use sketch to make new characters.

6. Design Credit Requirement

Credit must appear as: "Artwork by FlawlesslyPolishedd LLC" on all (“Artwork”)

7. Deliverables

High-resolution JPG/PNG/TIFF
300 dpi print-ready
Size per project specifications

8. Restrictions

(“Purchaser”) may NOT:

Sell or share raw artwork files
Claim authorship
Use artwork for Al datasets
Mint NFTs
Transfer or sublicense rights

9. Revisions, Cancellations & Refunds

Payments are non-refundable.
Cancelled projects forfeit payments made.
Extra revisions beyond agreement may incur fees.

10. Term

License is perpetual unless otherwise stated.

11. Governing Law

Governed by the laws of the State of Ohio.

Refunds

All sales and orders are final. Flawlessly Polishedd LLC Services & Products are all considered custom and are approved by customer prior to finalization. Therefore, making the purchase non-refundable & non-exchangeable. Once customer has approved final design, the design will be sent via email to the email address provided at checkout.
